Ukraine’s Supreme Court has issued a landmark ruling recognizing a same-sex couple, diplomat Zorian Kis and his partner Tymur Levchuk, as a de facto family, marking a major step forward for equality. The decision upholds a lower court ruling and sets an important precedent for other courts in the country.
Despite this judicial progress, legislation allowing same-sex partners to register a civil union has been stalled in parliament for three years. Without formal legal recognition, same-sex couples in Ukraine remain excluded from essential rights such as spousal hospital visits, medical decision-making, inheritance, and other protections afforded to immediate family members.
Public attitudes toward LGBT rights in Ukraine have shifted significantly, particularly following Russia’s 2022 invasion, with LGBT soldiers serving in the armed forces helping reshape public debate. A 2024 survey indicated that over 70 percent of Ukrainians support equal rights, demonstrating broad public backing for legal reforms.
In 2023, the European Court of Human Rights ruled that Ukraine violated anti-discrimination provisions and the right to respect for private and family life by failing to legally recognize same-sex couples. The court rejected the government’s claim that protecting “traditional families” justified excluding LGBT couples and noted that Ukraine already provides legal recognition for different-sex partnerships.
A new draft civil code currently defines “de facto family unions” exclusively as different-sex partnerships, explicitly excluding same-sex families. If enacted, this could put Ukraine in violation of the European Convention on Human Rights and complicate its efforts to align with European Union nondiscrimination standards.
The Supreme Court ruling affirms that same-sex couples constitute families and that the law must respect their rights. Advocates emphasize that legislative inaction leaves LGBT Ukrainians, including those serving on the front lines, in a legal vacuum. Parliament is urged to adopt a civil partnerships bill without delay, ensuring equality, legal protection, and dignity for all citizens.
